Updated Terms & Conditions for Inboxpays

Revised July 3, 2013

You must be a U.S. resident and 18 years of age or older to participate.

InboxPays, ("InboxPays.com" or "we") may revise these terms from time to time, at our sole discretion, by updating this posting.
Unless otherwise provided below, the revised terms will take effect when they are posted. Your continued use of the Service will signify your acceptance to the modified terms. Please review the terms on this website frequently to look for changes.

A. BASIC REQUIREMENTS FOR MEMBERSHIP. To maintain a Membership in the InboxPays Service, You must meet the following requirements and InboxPays reserves the right to terminate the Membership of anyone who fails to meet these requirements on an ongoing basis.

A.1) MEMBERSHIP ELIGIBILITY: To participate in InboxPays, you must be an individual at least 18 years of age and reside in the United States of America. Corporations or other business entities are not eligible to participate. It is required that members establish and maintain only one account, and that account must be registered to a unique e-mail address. InboxPays reserves the right to terminate any or all duplicate accounts resulting in the potential loss of earnings contained in such accounts.

A.2) PROVIDE ACCURATE INFORMATION. Member must provide valid and truthful contact information including First name, Last name, Email address, Phone number and Mailing Address to InboxPays. Member must provide this same valid and truthful contact information as required by advertiser or partner when completing any offer presented by or in conjunction with InboxPays. InboxPays reserves the right to terminate any account containing untruthful information or providing untruthful information to its advertisers or partners in the process of completing any offer presented by or in conjunction with InboxPays.

A.3) ENROLLMENT. To the full extent allowed by applicable law, InboxPays at its sole discretion and for any or no reason may refuse to accept applications for membership.

A.4) InboxPays NEWSLETTER AND OTHER EMAILS. By signing up for InboxPays, you are opting-in to receive InboxPays newsletters and other special offer emails and cash surveys. If you do not wish to receive these emails, you may opt-out at any time, by clicking on the opt-out link in the email messages you receive from InboxPays. Cash Mails: Please understand that Cash Mails is our way of showing appreciation to our members. As an attempt to keep fraud at bay, kindly understand that credit from Cash Mails will not be given to members that are confirming emails through mobile devices such as cell phones.
Please Note: There is a $25 Maximum Cash Mail Credit per payment request.

A.5) ACCOUNTS ARE NON-TRANSFERABLE. Your account is personal to You and is not transferable; You may not allow anyone else to use Your account or to receive free cash incentive earned by You; You may not use anyone else's account or act to accrue cash incentive for anyone else's account; You are responsible for keeping Your account information secret. InboxPays will not be liable for losses that are incurred through the use of Your account by a third party or the disclosure of your account information.

A.6) TERMINATION AND CANCELLATION. InboxPays at its sole discretion and for any reason or no reason at all may terminate any Members without prior notice for
(a) any violation of any provision of this Agreement;
(b) aiding in or promoting circumvention of the InboxPays Service;
(c) acting against the business interests or reputation of InboxPays;
(d) otherwise acting unlawfully in relationship to InboxPays, the InboxPays website or the InboxPays Service;
(e) breach of our Spamming Policy;
(f) inactivity (defined as the failure to earn any cash incentive in your InboxPays account) for a continuous six-month period; or
(g) any other reason at the discretion of InboxPays. If your account is terminated by InboxPays, You may not re-enroll or join under a new account unless formally invited to do so by InboxPays. (See Section I. below for more information about termination of accounts.) You may cancel Your Membership at anytime by notifying InboxPays from our FAQ page. If you decide to cancel Your membership and later wish to re-enroll, You will be assigned a new account number and You will not receive credit for cash incentive or cash made using Your previous account.

A.7) MEMBER ETIQUETTE. Member agrees not to use, or attempt to use, any part of InboxPays or the presentations for other purposes including but not limited to, tampering, hacking, spoofing, using robots or scripts, copying, distributing, modifying, or otherwise corrupting the administration, security, or proper function of any part of InboxPays or the presentations. Member also agrees not to make any attempt to earn or redeem earnings in a manner inconsistent with this Agreement, including without limitation attempting to earn earnings through other than legitimate channels as described on the InboxPays website, participating in purchasing or redemption fraud, or tampering with InboxPays links. InboxPays reserves the right to terminate any account violating this Agreement.

A.8) ONE ACCOUNT PER MEMBER OR HOUSEHOLD. You may only sign up once and maintain one Membership in the Service. InboxPays.com reserves the right to terminate duplicate accounts, resulting in the potential loss of accumulated credits.

A.9) PROVIDE CASH INCENTIVES. InboxPays offers cash incentives / cash surveys to members in exchange for completing signup process for trial offers. Signing up for the offers, advertised by our partners, is necessary in order to be eligible for cash incentives. If you sign up for the corresponding offer, it will take up to 8 weeks to receive the cash funds from the advertiser. If you have already taken the same survey, or were already a member of a specific group or organization, you will not be eligible for credit again for that particular survey. Please do not delete the confirmation emails you receive from the advertisers. These confirmation emails are required in order for us to investigate if your account is not credited in 8 weeks. The funds will be sent to the PayPal e-mail address registered on file with InboxPays. If your e-mail address changes and funds have already been sent to your e-mail address on file, InboxPays cannot redirect the funds to your new address. You can change your PayPal e-mail address in InboxPays at any time. PayPal.com is a FREE service that allows you to instantly receive cash over the Internet. Cash payments will only be made after the member's qualification to participate in a particular offer has been verified by InboxPays, the member completes that offer. InboxPays is not responsible if you lose, or misplace your funds via email. All cash payment amounts may be changed or modified at any time and at the discretion of InboxPays. Members are responsible for any taxes due as a result of payments made for their participation in InboxPays.

*Note: Payments will be transferred to US VERIFIED PAYPAL ACCOUNTS ONLY. It will take atleast 90 days from the *Requested Date, after verification.

A.10) REDEMPTION PROCESS REQUIREMENTS. InboxPays members must:
(a) provide and submit their email address and password which has been verified by InboxPays
(b) provide and submit their current mailing address
(c) provide and submit their correct first name
(d) sign-up, get approved for and activate (where applicable) membership, free trial or requirements posted by InboxPays. In some cases incentive for offers will show a pending approval for 6 to 8 weeks, till we are paid from the advertisers. Minimum payment threshold is approved $50 USD in your account. You have to accumulate $50 USD in your account for redemption. We pay our members through PayPal once you reach the minimum payment threshold. We DO NOT mail checks to any participants in our site, 100% of the payments are processed by PayPal. You can get your free PayPal account at www.paypal.com and you can update your information anytime by login here.

B.10) Payout Requirements. To request payout InboxPays members must have:
(a) current contact info
(b) verified phone number
(c) correct & validated PayPal entered in account
(d) a minimum of $25 Approved from Offers and/or Spin Wheel credits
(e) a maximum of $25 in Cash Mail Credits is allowed per payment request. Cash Mail Credits exceeding $25 will still accumulate under Carried Cash Mail Credits and will be eligible for future payment requests.

NO PAYMENT GUARANTEE: Inboxpays does NOT guarantee that a member will receive credit for a completed survey and offer. Inboxpays will make reasonable efforts to track and report your signing up for offers but does not guarantee the precision of the process. We reserves the right to refuse the credit to members for offers for variety of reasons, including, but not limited to, Lack of appropriate information, Improper signup, Improper browser settings, Errors in third party reporting, and / or any other reason.

Cancellation: Signup with free trials may carry a shipping charge and after the free trial, you may be charged by the advertiser. It's totally individuals responsibility to cancel it by email the advertiser for cancellation for services or product brought, if you don't want to continue.

A.11) TIME LIMIT. If a User's Account remains inactive for a period of 3 months without being reactivated, their Account will be permanently removed and all earnings will be forfeited.

B. YOUR RELATIONSHIP TO InboxPays. By filling out the membership information, you are applying to receive a service. Your relationship to InboxPays is one of an independent contractor and/or customer. No employee-employer relationship is created by your use of the Service.

C. NO TAMPERING. You agree not to tamper with the proper functioning and tracking of the Service. Emulating or "faking" usage will lead to termination of your account and may lead to legal action.

D. You agree and understand that although InboxPays will make reasonable efforts to make the activity detection process fair and consistent, InboxPays does not guarantee the precision of the process. You will only be credited for completing offers as reasonably determined by InboxPays.

E. PARTNER OFFERS. If you are accepted by InboxPays as a Member of the InboxPays Service and meet all the requirements provided in this Agreement You may earn cash for completing partner survey panels and offers. Member agrees to comply with this Agreement of InboxPays and its advertisers and partners in the process of completing any offer presented by or in conjunction with InboxPays. InboxPays reserves the right to terminate any account violating this Agreement or the Agreement of any of its advertisers or partners.

E.1) There are conditions in order for InboxPays members to receive a cash incentive. InboxPays members must have cookies enabled. InboxPays members must access the partner site through InboxPays. These conditions are mandatory so that the partner will know that the InboxPays member used InboxPays to reach the partner site. You agree that all redemption processes shall be done through the Member Accounts page on InboxPays.

E.2) InboxPays does not warranty, guarantee, or insure the quality of any product or service requested from any of the partner offers.

F. REFERRALS.

F.1) Tracking. InboxPays users have an opportunity to refer this site to their friends. Users can find the Referral link in the Member's Section.

F.2) SPAM AND UNSOLICITED EMAIL. Users are not allowed to SPAM i.e.; send unsolicited email to persons whom they do not know, for the purpose of referring other users to InboxPays. We are unable to list the possible acceptable and unacceptable methods of advertising since the list is endless. If a User has a specific question as to whether or not a particular advertising method is acceptable, they should contact us prior to engaging in that action by using our Contact Us link.

Do's and Don't for Advertising:
  1. Users may not send Unsolicited E-Mail advertising to InboxPays.
  2. Users may send Solicited E-Mail to their subscribers advertising to InboxPays. However, Users must adhere to all current legislation, including the CAN-SPAM Act. As part of this Act, Users must ask their subscribers against our Suppression List and include a link for subscribers to add themselves to our Suppression List. For more information on our Suppression List, please contact us. InboxPays reserves the right to refuse distribution of our Suppression List for any reason.

E.3) Refer-a-Friend Service. Users may use our Refer-a-Friend Service to automatically send an E-Mail notification to their friends. However, if the User's Refer-a-Friend E-Mail results in a SPAM complaint, the User's Account may be terminated. Users should use the Refer-a-Friend Service to notify only their close personal friends.

E.4) False Advertising. Users may not make untrue or exaggerated statements when advertising InboxPays or engage in any unfair or misleading trade practice as defined by law. For example, a User may not put on their Web Site: "Join InboxPays and get paid $1.00 for every E-Mail you read!" If the User provides information about InboxPays on their website, they must ensure the information is updated and accurate.

E.5) Referral Bonuses. The Referral Bonus is credited to a User's Account when the User they referred has requested and received their first payment from InboxPays.

F. MONITORING YOUR ACCOUNT. You may view your account balance at the InboxPays "Account" web page. Account information is updated as confirmation is received from InboxPays marketing partners. If you have a question about your account, contact us from our FAQ page.

G. HOW TO UNSUBSCRIBE. Users may receive email confirming their registration with the Website, co-registration with Advertisers and subsequent entries in our sweepstakes and games, as well as promotional marketing of products and services under other Company brands or from third parties. To unsubscribe from any Company or Advertiser's email list, please visit the specific website for details on how to unsubscribe or follow unsubscribe instructions which should be included with any email message sent.

H. YOUR RELATIONSHIP WITH MARKETING PARTNERS. Your relationship with marketing partners whom InboxPays delivers offers for, including payment for and delivery of related goods or services, entry into and operation of promotions, discounts or contests, and any other terms, conditions, warranties or representations associated with such dealings, are solely between You and such marketing partner. You agree not to hold InboxPays liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the content provided by such partners through the Service.

I. TERMINATION. If a Member's account is terminated by InboxPays, InboxPays may refuse to "approve" a cash incentive if such cash incentive were earned in violation, or after violation, of this Agreement or were otherwise unlawfully obtained by the Member. If your account is terminated by InboxPays, You may not re-enroll or join under a new account unless formally invited to do so by InboxPays.

J. DISCLAIMER OF WARRANTIES. YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, InboxPays EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED BY LAW, CUSTOM OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. InboxPays MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICE OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICE.

K. LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, NEITHER InboxPays NOR ANY OF ITS MEMBERS, SUBSIDIARIES, PUBLISHERS, SERVICE PROVIDERS, LICENSORS, OFFICERS, DIRECTORS OR EMPLOYEES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF USER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL InboxPays TOTAL CUMULATIVE LIABILITY TO ANY MEMBER UNDER THIS AGREEMENT EXCEED AN AMOUNT EQUAL TO THE VALUE OF ONE DOLLAR CASH FROM THE InboxPays WEBSITE.

L. GOVERNING LAW AND OTHER TERMS. Any action related to this Agreement will be governed by California law, excluding
(1) principles of conflicts of laws, and
(2) the United Nations Convention on Contracts for the International Sale of Goods. Any action relating to this Agreement shall be brought in the state or federal courts located in the Northern District of California, and You hereby submit to the exclusive jurisdiction and venue thereof. You agree to comply with the laws of California and the United States that apply to the use of this Service and the compensation you may receive. If the laws of your country, state, or province of residence prohibit or limit your participation in this Service, then you are responsible for complying with such laws and you agree to indemnify InboxPays against any breach. If any part of this Agreement is held to be unenforceable, the unenforceable part shall be given effect to the greatest extent possible and the remainder will remain in full force and effect. This Agreement is personal to you and you may not transfer, delegate, or assign this Agreement, your referral network, your InboxPays account or other benefits you receive as an InboxPays Member to anyone. Any attempt by You to assign or delegate this Agreement shall be null and void. InboxPays may assign this Agreement at its sole discretion.

SECURITY To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, InboxPays has used appropriate industry standard procedures to safeguard the confidentiality of your personal information, such as firewall, encryption, token authentication, application proxies, monitoring technology, and adaptive analysis of network traffic to track abuse of our network and its data. However, no data transmitted over the Internet can be 100% secure. As a result, while we strive to protect your personal information, InboxPays cannot guarantee the security of any information that you transmit to us or from our sponsors and you do so at your own risk.

This Agreement constitutes the entire Agreement between You and InboxPays in connection with general membership in InboxPays and supersedes all prior agreements between the parties regarding the subject matter contained herein. If any provision of this AGREEMENT is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of this AGREEMENT will remain in force. No failure of either party to exercise or enforce any of its rights under this AGREEMENT will act as a waiver of such rights.

K. FRAUD ACTIVITY. If at any time your account is discovered to have any fraudulent activity, as determined by us, your account may be terminated without pay. Fraudulent activity is defined as, but not limited to the following: 1) Using false or misleading personal information while signing up for offers 2) Using a fake or auto/computer generated credit card number to complete an offer.

K.1 Also, InboxPays may not pay any user for any offer that has been charged back to the advertiser. If a charge back occurs under your account, as determined by us, your account may be terminated without pay.

K.2) InboxPays feels very strong about fraudulent activity. If there are any questions regarding these rules feel free to contact support@InboxPays.com with your query and we will kindly respond.

L. FRAUD USERS. Recently we have found that many of our users are creating fake accounts and using fraudulent credit cards to sign up for offers. This is causing our sponsors to shut down their merchant accounts, and stop business with us sometime resulting in no payment. As a result, we will be paying all of our members 90 days after approval of the transaction so we have enough time to sift through the fraudulent users who cause this, with helpful information from our advertisers.

L.1) We will be taking legal action if we find any of our members having dummy accounts (more than one [1]) per house hold (as stated in our terms and conditions) or people using prepaid or fraudulent credit cards with our sponsors (advertisers). If you are found to have done any of the above stated points, your account will be terminated with all earnings being held, plus any necessary legal action.

L.2) Please remember this is may be only temporary as we make these changes to our system for you, so we can provide you with the best offers.
